AIM Report Software Terms of Service

Terms of Service for all AIM Report subscriptions.

1. Introduction

These Terms of Service (“Terms”) govern access to and use of the AIM Report Software (“AIM Report,” “AIM”) provided by the International Institute for Sustainable Laboratories (I2SL), a nonprofit corporation located at 2300 Wilson Boulevard, Suite 350, Arlington, VA 22201. By continuing to use the AIM Report Software, users affirm that they have read, understood, and agree to be bound by these Terms, either on behalf of themselves or an organization they represent. If you do not agree to these Terms, do not access or use the AIM Report.

2. Definitions

User: An individual who accesses or uses the AIM Report software, whether as a paid (Full) subscriber or a demonstration (Demo) user.

Authorized User: An individual with a registered login who is authorized to access the AIM Report software under a valid subscription.

Device: Any computer, tablet, or internet-connected device from which the User accesses the AIM Report software.

Measure: An energy-saving strategy or operational improvement analyzed by the AIM Report software.

Package: A customized grouping of selected measures, created by the user, within the AIM Report tool.

AIM Report PDF: A PDF report generated by the software summarizing selected measures, estimated costs, and potential savings.

Measure Cost: An estimated implementation cost for a measure, as provided by the AIM Report software.

Case Study: An example or reference project related to a measure, used to inform the user about real-world application of measures.

3. User Access

Users access the AIM Report software through the I2SL Laboratory Benchmarking Tool (LBT). The LBT is a web-based software service allowing benchmarking of laboratory energy use. Users can access the AIM Report software via a free Demo account or by subscribing to a paid plan. The free Demo includes access to a limited number of energy conservation measures and case studies, as well as the ability to create packages with the limited number of measures  and export the results into a PDF report.

To access the full suite of available energy conservation measures and features, a current paid subscription is required. Each paid subscriber’s user account is valid for a single user and may not be shared. Users may log in from multiple devices, but only one device may be active per account at a time. Unauthorized sharing of login credentials is strictly prohibited.

There is no limit on the number of buildings users may input during their active subscription. Users may create and export unlimited packages and reports throughout the subscription period. Following subscription expiration, they can still export AIM Report PDFs created during the paid subscription period, but they may not create new reports for packages containing non-Demo measures.

4. I2SL Provisions

I2SL will provide subscribers and Demo users with 24/7 access to the AIM Report software, subject to routine maintenance and unforeseeable system interruptions. I2SL will maintain the algorithms and systems that analyze user input and match lab buildings with potential energy conservation measures based on their parameters. Output includes relevant measure names and descriptions, estimated energy savings and implementation costs, and case study names and descriptions when available and relevant. I2SL also provides secure cloud-based storage of user data, packages, and reports.

5. User Provisions

Users agree to submit accurate, complete, and updated data to the best of their ability. They warrant they are authorized to enter building and utility data into the platform on behalf of the building owner, operator, or client. It is the user’s responsibility to refine or correct data entries as needed.

Users agree not to represent AIM Report outputs as formal engineering audits or on-site evaluations. The outputs of the software are designed for high-level analysis and prioritization, not to replace professional, onsite energy assessments or engineering designs. AIM Report PDFs may be downloaded and shared but must not be altered or excerpted in ways that misrepresent the original content.

To use the AIM Report software, users must enter a minimum set of laboratory building and utility data. By agreeing to these Terms, users grant I2SL a license to store and access this data. I2SL commits to maintaining confidentiality and will not share personally identifiable information or building-specific information without permission except when required by law. Any such compelled disclosures will be preceded by reasonable notice to the user.

I2SL stores user data, including contact details, securely via AWS cloud infrastructure. All personally identifiable information is restricted from public access. I2SL reserves the right to contact users with relevant education and information regarding AIM Report software updates, outages, and learning opportunities.

Users retain ownership of individual AIM Report PDFs they generate, including any customized packages. I2SL holds copyright over the generated reports and software frameworks but grants users perpetual usage rights for their own reports. Users may not alter PDF reports, but information in them can be referenced by the user. I2SL may analyze user interactions with the tool in the aggregate for internal improvements, product development, and analytics.

7. Report Limitations and Disclaimers

The AIM Report software is a modeling tool designed to identify potential opportunities for lab building energy savings based on input data. It is not a substitute for onsite professional assessments, audits, or engineering designs.

All estimates of cost savings, energy use reduction, and implementation costs are intended as high-level approximations only, and I2SL is not responsible for any inaccuracies of these estimates or underlying calculations. Actual results depend on building-specific factors, implementation quality, and evolving energy prices. Users are solely responsible for evaluating and validating both their input data and assumptions and the software’s results. I2SL disclaims all liability for the performance of any measures implemented based on AIM Report outputs. 

Case studies are included for informational purposes and may be based on publicly available or third-party sources. I2SL makes no guarantees about their accuracy or applicability to user projects.

8. Indemnification and Limitation of Liability

Users agree to indemnify I2SL and its contractors, directors, volunteers, and vendors from all liabilities arising from use of the AIM Report software. I2SL’s total liability shall not exceed $100 USD, and no liability is accepted for indirect, special or consequential damages, including loss of profits, revenue, or data. I2SL shall also not be liable for any losses arising from or related to downtime or unavailability of the AIM Report software.

9. Force Majeure

I2SL is not liable for service interruption due to events beyond its control, including but not limited to natural disasters, war, terrorism, internet outages, or labor unrest.

10. Subscriptions and Renewals

Access beyond the Demo version requires a paid subscription. Payment is required at the time of subscription via credit card, which will remain on file in a secure paywall system (Stripe) to allow for automatic renewal of both monthly and annual subscriptions.  Non-payment leads to service termination after a 7-day grace period. Annual subscriptions may be transferred once per year by contacting Labs2Zero@i2sl.org.

11. Disputes and Termination

All disputes must be submitted to I2SL for review. Applicable laws are those of the United States and the Commonwealth of Virginia. Termination does not void prior agreements on confidentiality, data usage, and liability. Expired subscribers may continue to access prior AIM Report PDFs but cannot generate new reports containing non-Demo measures

Users who violate these Terms of Service, e.g., using one subscription for multiple users, may be subject to termination of their subscription. Should a subscription be terminated for violating the Terms of Service prior to the end of the subscription period, no refund will be provided to the user.

12. Changes and Updates

These Terms may be updated by I2SL as needed and without notice. Continued use constitutes acceptance of updates. Users should review Terms periodically.

13. Acceptable Use

Users agree to use the AIM Report software in compliance with all applicable laws and regulations. Users shall not: attempt to gain unauthorized access to the software, underlying systems, or other users’ data; reverse-engineer, decompile, or disassemble the software; use the software in a manner that may impair, overburden, or disable the system; nor upload or transmit any malware, viruses, or harmful code.

14. Intellectual Property Rights

All content, features, and functionality of the AIM Report software—including text, graphics, logos, software code, AIM Report PDFs, and models—are the exclusive property of I2SL or its licensors and are protected by U.S. and international copyright, trademark, and intellectual property laws. Except as expressly authorized, users may not reproduce, distribute, modify, or create derivative works.

15. License Grant and Restrictions

Subject to these Terms, I2SL grants users a limited, non-exclusive, non-transferable, revocable license to access and use the AIM Report software for internal business or organizational purposes. This license does not permit resale or redistribution.

16. Feedback and Suggestions

Any feedback, comments, or suggestions users submit regarding the AIM Report software may be used by I2SL without obligation, acknowledgment, or compensation. Users grant I2SL a perpetual, royalty-free license to use and incorporate such feedback.

17. Third-Party Services and Integrations

The AIM Report may include links to or integrations with third-party services (e.g., payment processors, sponsors’ websites, websites hosting case studies). I2SL is not responsible for the content, functionality, or data practices of third parties. Use of such services is at the user’s risk and subject to their respective terms of service and privacy policies.

18. Entire Agreement and Severability

These Terms, along with the LBT privacy policy (https://lbt.i2sl.org/help/privacy) and any subscription details, constitute the entire agreement between the user and I2SL. If any provision is found to be invalid or unenforceable, that provision shall be severed and the remainder of the Terms shall remain in full force.

Appendix: Data Privacy and GDPR Compliance

I2SL is committed to protecting the privacy of all users of the AIM Report software, including users in the European Union (EU), United Kingdom (UK), and other jurisdictions with strong data protection laws. This section outlines user rights and I2SL’s compliance with the EU General Data Protection Regulation (GDPR), U.S. privacy laws, and other applicable legislation.

Legal Basis for Processing:

I2SL collects and processes personal and building-related data based on:

  • User consent (GDPR Article 6(1)(a));
  • Legitimate interest in providing, maintaining, and improving the AIM Report service (GDPR Article 6(1)(f)).

User Rights:

Under applicable data protection laws, users have the right to:

  • Access the personal data I2SL holds about them;
  • Request correction of inaccurate or incomplete data;
  • Request deletion of their personal data (“right to be forgotten”);
  • Restrict or object to the processing of their data;
  • Request transfer of their data (data portability); and
  • Lodge a complaint with a data protection authority.

To exercise any of these rights, users may contact I2SL at Labs2Zero@i2sl.org with the subject line “Data Request”. I2SL will respond to requests within the timeframe required by applicable law.

Data Retention:

I2SL retains user and facility data only for as long as necessary to fulfill the purposes for which it was collected, or to comply with legal, regulatory, or contractual obligations. Users may request deletion of the data they input at any time by contacting Labs2Zero@i2sl.org.

International Data Transfers:

User data may be processed and stored outside of the user’s country, including in the United States.

Cookies and Tracking Technologies:

The AIM Report software and the I2SL Lab Benchmarking Tool may use cookies or similar technologies to improve site functionality and gather usage analytics. Users can control cookie settings in their web browser. By continuing to use the service, users consent to the use of cookies.
